These Terms of Service ("Terms") govern your use of the website located at jackspearmanwhitlatchllc.com (the "Site") and any custom furniture orders, design services, or other transactions conducted with Jack Spearman Whitlatch LLC ("Company," "we," "our," or "us"), a Kentucky limited liability company located at 712 N 24th St, Paducah, KY 42001.
By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
You may use the Site for lawful purposes related to learning about our products and services, submitting inquiries, and engaging with our content. You agree not to:
All content on this Site — including text, photographs, design drawings, graphics, logos, and videos — is the property of Jack Spearman Whitlatch LLC or its content suppliers and is protected by United States and international copyright law. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
All custom furniture orders begin with a written design consultation and result in a signed Purchase Agreement ("Agreement") detailing the scope of work, specifications, pricing, timeline, and deposit requirements. No work begins until a signed Agreement and deposit are received.
Design changes requested after the Agreement is signed and production has commenced may result in additional charges and revised delivery timelines. All changes must be agreed upon in writing before work is modified.
Estimated lead times are provided in good faith based on current production capacity. We will promptly notify you of any significant delays. Lead time delays of less than four (4) weeks do not constitute a breach of contract and do not entitle the client to a refund of deposit.
Because all pieces are custom-made to order using client-specified materials and dimensions, cancellations are subject to the following policy:
If we are unable to fulfill your order due to circumstances within our control, we will provide a full refund of all payments made and, where possible, offer an alternative production timeline or substitute materials.
We provide white-glove delivery and installation within the continental United States. Delivery fees are itemized in your Purchase Agreement. You are responsible for ensuring adequate access to your delivery location (elevator dimensions, doorway widths, stair clearances). We will discuss access requirements during the design phase. Delays caused by inaccessible delivery locations may result in rescheduling fees.
Risk of loss transfers to the client upon successful delivery and acceptance. Please inspect all pieces at the time of delivery and note any damage on the delivery documentation before signing.
All solid wood furniture manufactured by Jack Spearman Whitlatch LLC is covered by a 25-year structural warranty against defects in craftsmanship and materials under normal residential use. This includes frame integrity, joinery failure, and finish delamination not caused by misuse or environmental damage.
Upholstered seating and headboards are warranted for 5 years against defects in fabric, spring, and cushion construction under normal residential use. Fabric wear, fading from sunlight, and damage from pets or accidents are not covered.
Lighting products are warranted for 2 years against electrical and structural defects. Bulb replacement is not covered under warranty.
Warranties do not cover: damage from misuse, neglect, or accidents; exposure to extreme humidity or temperature fluctuations; commercial use (unless specifically purchased under a commercial contract); unauthorized repairs or modifications; or normal wear and natural wood movement (expansion/contraction).
To submit a warranty claim, contact us at js.w@jackspearmanwhitlatchllc.com with your order number, photographs of the issue, and a description of the defect. Approved warranty repairs are performed in our Paducah workshop. We cover return shipping on approved warranty claims.
Natural hardwood furniture requires basic care to maintain its beauty and protect your warranty. We provide a written care guide with every delivery. General guidance includes: avoid placing furniture in direct sunlight or near heat sources; use coasters and felt pads; clean with a damp cloth and dry immediately; apply furniture oil or wax annually. Damage resulting from improper care is not covered under warranty.
To the fullest extent permitted by applicable law, Jack Spearman Whitlatch LLC's total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you for the specific product or service giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages.
You agree to indemnify and hold harmless Jack Spearman Whitlatch LLC, its officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any dispute arising from these Terms or your engagement with our services shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved by binding arbitration in McCracken County, Kentucky, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.
